2. Scope of Application

These Terms of Service apply to all orders placed via the Georgious website (georgious.nl). By placing an order, the customer agrees to these terms.

3. Products

Georgious offers high-end, design lighting products.

• Products may be handmade or produced in limited editions.
• Minor variations in finish, color, or detail may occur and do not constitute defects.
• Product images are indicative and may differ slightly from the final product.

4. Pricing & Taxes

• All prices displayed on the website include applicable VAT (e.g. 21% for the Netherlands) unless stated otherwise.
• For orders outside the European Union, VAT may be excluded. Import duties, taxes, and customs fees are the responsibility of the customer.
• Georgious reserves the right to change prices at any time.

5. Orders & Payment

• An order is binding once payment has been successfully completed.
• Payments are processed via secure third-party providers, including Mollie.
• Georgious reserves the right to refuse or cancel orders in cases of suspected fraud or error.

6. Shipping & Delivery

• Estimated delivery times are indicative and not guaranteed.
• For in-stock items within the EU, delivery typically takes 3–5 business days.
• For pre-orders, the estimated shipping period will be clearly stated on the product page.
• Georgious is not liable for delays caused by shipping carriers or customs processes.
• Risk of loss or damage transfers to the customer upon delivery.

7. Returns & Right of Withdrawal

• Consumers within the EU have the right to withdraw from their purchase within 14 days of receiving the product.
• Returned products must be unused, undamaged, and in original packaging.
• Return shipping costs are the responsibility of the customer unless the item is defective.
• Refunds will be issued within 14 days after receipt and inspection of the returned product.

Exceptions:

• Custom-made or personalized products are excluded from the right of withdrawal.

8. Warranty & Defects

• Georgious provides a legal warranty in accordance with EU law (minimum of 2 years).
• If a product is defective, the customer must notify Georgious within a reasonable time and provide supporting evidence (e.g. photos).
• Georgious may repair, replace, or refund the product at its discretion.

9. Damage During Transport

• Any damage must be reported within 48 hours of delivery, including photographic evidence.
• Failure to report within this timeframe may result in rejection of the claim.

10. Use & Installation

• Products must be installed and used in accordance with provided instructions.
• Georgious is not liable for damage caused by incorrect installation or misuse.

11. Limitation of Liability

• Georgious is not liable for indirect, incidental, or consequential damages.
• Total liability is limited to the purchase price of the product.

12. Intellectual Property

All designs, products, images, and content are the intellectual property of Georgious.

• No part may be copied, reproduced, or used commercially without prior written consent.

13. Website Use

• The website must not be used for unlawful or fraudulent purposes.
• Georgious does not guarantee uninterrupted or error-free operation of the website.

14. Privacy

Personal data is processed in accordance with the Georgious Privacy Policy and applicable GDPR regulations.

15. Governing Law

These Terms of Service are governed by the laws of Netherlands.
Any disputes shall be submitted to the competent court in that jurisdiction.

16. Dispute Resolution

Consumers in the EU may use the Online Dispute Resolution (ODR) platform provided by the European Commission.

17. Changes to Terms

Georgious reserves the right to modify these Terms of Service at any time. Updated terms apply to all future orders.
